Probate is the legal process through which a court first proves the validity of a will and then oversees distribution of assets left by the deceased’s last will and testament. Assets consist of anything of value an individual owns, including real estate, personal property, cash, stocks, bonds and other investments.
Probate isn’t always a necessity. If you die and have few or no assets, or if you have a surviving spouse or own property with someone else, that person will become the owner of the property.
